TERMS AND CONDITIONS OF SALES
With the purchase of tickets for events and educational activities with their use you accept the conditions for access to events defined in the regulations for the health emergency in reference to COVID-19 detailed below.
1. TERMS AND CONDITIONS FOR COVID-19 EMERGENCY
The purchaser of the ticket(s) or season ticket(s), on the date of purchase, declares under his/her responsibility that the participant(s)/user(s) of the ticket(s):
- are not currently screening positive for Covid-19 or undergoing medical containment measures for Covid-19;
- do not have symptoms associated with Covid-19;
- have not come into contact within the previous 14 days with persons who are positive or quarantined or have symptoms that can be associated with Covid-19;
- are aware of the infection containment measures in place as of this date;
- are aware of the sanctions provided for in art. 4 of Decree Law No. 19 of March 25, 2020;
- undertake to promptly communicate any occurrence of the above-mentioned symptoms within 14 days of participation in the event in question;
- in relation to the purchase of tickets for the contiguous seats reserved for “CONJUNCTS”, declare that there are relationships of kinship and / or affinity between the occupants of the seats falling within those provided by the COVID DPCM and that this declaration relates to individual responsibility;
- participants must also follow the instructions received from the GAL Hassin Foundation to access and take their places at the event or at the place of the educational and outreach activities.
2. GENERAL CONDITIONS OF SALE (CGV)
The following conditions regulate the distance sale of access tickets to the GAL Hassin Foundation, to the educational and outreach activities and to the events organized by the same, as well as accessory services or services related to the activities or events themselves. The sale is carried out by the GAL Hassin Foundation. Before proceeding to the conclusion of the Purchase, the User must carefully read all the information provided.
3. OBJECTS AND RESPONSABILITIES OF THE ACTIVITIES
The GAL Hassin Foundation (hereinafter the “Manager”) is the owner and Manager of the site galhassin.it (hereinafter the “Site”).
The Site offers to Users (hereinafter “User”) who access it services of:
- sale of admission tickets (hereinafter “tickets”) for admission to the GAL Hassin Foundation for guided tours of the Museum, Planetarium, Space and Time Park and Observation Terrace facilities of the Manager;
- sale of events and related services;
- sale of gadgets (such as books, meteorites, caps, sundials, mugs, magnets, pins, etc.).
These services will hereinafter be defined as “Purchases”, while the educational and outreach activities, events for the public and schools will hereinafter be defined with the generic indication of “Events”.
It is understood that any plural definition will apply to the relevant singular term and vice versa.
The selection of Securities for which the Manager permits Purchases is at the sole and absolute discretion of the Manager.
The Manager is not responsible for any problems or inconveniences arising from the malfunction or insufficient functioning of any component of the Internet network and the media on which it operates, such as, by way of example, telecommunication lines.
The Manager is also not responsible for any problems or misunderstandings arising from incorrect and / or insufficient data communicated by the User for the successful completion of the Purchase, such as, by way of example, incomplete shipping addresses or non-existent and incorrect email.
Moreover, the Manager is not responsible for any expenses and damages, direct or indirect, of any nature, falling on the User, in relation to Purchases made on the Site and reserves the right to modify, suspend or interrupt any service and functionality of the Site for technical and/or organizational reasons.
Ticket prices are VAT-exempt in accordance with art. 10 no. 22 of Presidential Decree 633/72.
The prices of any other products, if any, are inclusive of VAT. In the event of changes in VAT rates and other indirect taxes, the corresponding changes in prices will be applied plus or minus.
The Manager reserves the right to change the prices of admission tickets, services and goods at any time.
5. HOW TO ACCESS THE PURCHASE ON THE SITE
The possibility of making a Purchase is allowed to all Users able to access the Internet. Hardware and software necessary for access and any expenses related to connection, operation and maintenance are the responsibility of the User.
Access to the Purchase is made solely through the address galhassin.it.
No registration on the Site is required for the Purchase.
The User who wishes to make a Purchase on the Site is obliged to respect what is proposed in these GTC and to carefully follow and accept what is indicated on the various pages during the Purchase procedure in order to correctly complete the transaction, otherwise the Purchase will not be concluded.
The Purchase will be complete and valid only if:
- the User enters all the requested data (except those indicated as optional);
- the payment transaction has been authorized by the payment platform.
The mere request by the User for Tickets, services or goods (filling of the “shopping cart”), as well as the mere assignment to the User of an order/reservation number by the Site, do not in themselves constitute any obligation either for the User or for the Manager.
At the end of the Purchase, the User will receive confirmation by email, to the email address provided during the Purchase procedure. The User is required to verify that the email provided is correct and valid and is solely responsible in case of incorrect and/or incomplete communication of such address.
6. PURCHASING PROCEDURE
The User, to complete a Purchase will have to
- choose the entrance of his/her interest (date and time) through the appropriate form,
correctly enter all the data required by the reservation: number of adults, number of children 5-10 years old, number of children 11-14 years old and number of disabled people;
- choose the type of price according to the indications provided by the Manager;
- insert the chosen tickets in the Purchase cart;
- proceed with another purchase if necessary
correctly enter all the data required for identification, payment and shipping;
- proceed with the final confirmation of the transaction.
In case the User is a School, for the reservation request the School will have to:
- download the “School visit request form”;
- fill in this form and attach it to the booking request in the form of the web page on the site galhassin.it. The form must include the stamp and signature of the school (as acceptance of privacy regulations), the number of students, the number of teachers (free for every 15 students) and the number of students with disabilities.
Subsequently, upon receipt of these data, the Manager will enter them on the online booking portal allowing the school to make the payment by bank transfer, credit card/PayPal.
7. PAYMENT METHODS
The customer is allowed to choose one of the following methods of payment: Paypal, Credit Card, Bank Transfer.
If you choose “PayPal”, at the conclusion of the online transaction, PayPal will immediately charge the amount of the purchase made.
In the event of changes or cancellation of an Event by the Manager or cancellation of the Event by the Customer, the amount related to the cancelled goods will be credited back to the customer’s PayPal account.
The timing of re-crediting on the payment instrument chosen within the PayPal account depends exclusively on PayPal and the banking system. At no time during the purchase process is the Manager able to know the information relating to the buyer’s credit card or other method chosen within the PayPal wallet.
VARIATIONS OR CANCELLATION OF EDUCATIONAL AND OUTREACH ACTIVITIES OR EVENTS and section 11. REFUND FOR CANCELLATION OF EDUCATIONAL AND OUTREACH ACTIVITIES OR EVENTS, respectively,
Once the amount has been re-credited, in no case can the GAL Hassin Foundation be held responsible for any damage, direct or indirect, caused by delays in the actual re-crediting due to Paypal or the banking system. In no case can the GAL Hassin Foundation be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment for products purchased on galhassin.it.
7.2 Credit Card
If you choose “Credit Card” as payment method, the user is redirected to the secure site and certified PayPal, which manages (authorizing or denying) the payment transaction.
The completion of the Purchase is subject to the User’s correct entry of credit card details, a valid email address and security credentials, if required.
The Manager is not able to access any sensitive data regarding the transaction, nor is therefore able to make any intervention in case of transaction denied by the Credit Card for any reason.
Credit Card Purchases are considered successful only after the Manager has received authorization from the acquiring bank.
Due to the particular characteristics of the sector and the regulations in force in the field of ticketing, any practice for which the Manager receives regular payment is implicitly and definitively understood to be accepted by the User.
It will not be possible to modify what has been purchased (such as, merely by way of example, shifting of the time slot of entry) and/or renunciation by the User once the Purchase has been concluded and confirmed.
7.3 Bank Transfer
If you choose Bank Transfer, you must pay the fee to the bank account indicated and indicate the correct reason, as described event by event on the Site.
8. DELIVERY AND/OR SHIPMENT OF TICKETS OR MERCHANDISE, AS WELL AS USE OF PURCHASED SERVICES
It is always recommended to pay attention and refer to what has been communicated during the Purchase procedure.
As a general rule, unless otherwise notified, the collection of tickets at the place of the event and the use of ancillary services takes place upon presentation by the User of the confirmation of the Purchase, sent by email or downloaded from the Site in the moments immediately following the successful conclusion of the Purchase.
The Purchase Confirmation can then be presented to the appropriate personnel at the Event, either in hard copy or digitally (smartphone, tablet, etc.). In the case of purchase of services, the same indications given for Tickets apply, while in the case of goods, any additional procedures will be indicated from time to time.
10. USE OF PURCHASED SERVICES
In the case of purchasing reduced-price tickets (e.g. reduced price tickets for children aged 5-10), or gifts (vouchers) with the possibility of booking (e.g. promotional ticket holders entitled to free admission), the Purchaser must carefully read the information provided in the relevant sections of the Site and, by making the purchase, implicitly declares that he/she is in possession of the necessary requirements.
These requirements can be verified by the personnel in charge at the time of entry to the educational-divulgative activity or event.
If, at the time of such verification, the Buyer/User of the Ticket is unable to prove that he or she meets the requirements (for example, is unable to prove his or her age), he or she will lose the right to access the educational ando outreach activities or the event scheduled at the reduced price and will have to pay the difference between the reduction and the cost of the full ticket.
11. VARIATIONS OR CANCELLATION OF EDUCATIONAL AND OUTREACH ACTIVITIES OR EVENTS
In the event of cancellation, postponement or change of an Event for which the User has made a Purchase, the rules and procedures adopted by the Manager from time to time, in accordance with the law, shall apply.
The User will be able to contact the Site through the address firstname.lastname@example.org and obtain all the information on the rules and procedures provided by the Manager. At the same time the same information will be published on the Site. The User can and must pay attention to what is published on the site and to what may be communicated through the media.
In case of partial and/or total refunds of the tickets, or replacements with other tickets, the Manager will refund the value of the tickets or part of this value, net of any expenses for the shipment of the Tickets.
Once the Manager has received the tickets to be cancelled, the Manager will provide for the fiscal cancellation and will refund the amount to be refunded as quickly as possible by transferring it to the credit card used for the Purchase, unless otherwise agreed on a case by case basis.
12. REFUND FOR RENOUNCEMENT TO EDUCATIONAL AND OUTREACH ACTIVITIES OR EVENTS
In the case of renouncement to the educational and outreach activities or events by the client, the cancellation of the reservation purchased on the site galhassin.it can only be made by written request via email to email@example.com up to 5 days before the start date of the activity itself. Any refund will not be sent automatically.
13. OWNERSHIP AND PROHIBITION OF RESALE OF THE SERVICE
It is forbidden to use – even partially – the information found on the Site without prior authorization from the Manager. The prohibition extends explicitly to the resale of Purchases, as presented and offered on the Site.
14. APPLICABLE LAW AND JURISDICTION
The Contract is subject to Italian law. It is subject to the application to Users who do not have their habitual residence in Italy of any more favorable and mandatory provisions of the law of the country in which they have their habitual residence.
Please note that in the case of a Consumer User, any dispute relating to the application, execution and interpretation of these GTC or the Purchase shall be subject to the jurisdiction of the place where the User resides or has elected domicile.
